The Policy is designed to assist you in understanding how we collect, use and safeguard the personal information you provide to us and to assist you in making informed decisions when using our Website(s) and our products and services. As a general policy, no personal information is collected from our visitors except when collecting form information which is volunteered by you. DISPUTES AND AGREEMENT TO ARBITRATE 

By using the Website(s) or otherwise using our services, you and Kitchen Guard agree that, if there is any controversy, claim, action, or dispute arising out of or related to your use of the Website(s), or the breach, enforcement, interpretation, or validity of this Policy or any part of it (“Dispute”), both parties shall first try in good faith to settle such Dispute by providing written notice to the other party describing the facts and circumstances of the Dispute and allowing the receiving party 30 days in which to respond to or settle the Dispute.

You and the Company agree that this dispute resolution procedure is a condition precedent that must be satisfied before initiating any litigation or filing any claim against the other party. IF ANY DISPUTE CANNOT BE RESOLVED BY THE ABOVE DISPUTE RESOLUTION PROCEDURE, YOU AGREE THAT THE SOLE AND EXCLUSIVE FORUM FOR SUCH DISPUTE WILL BE DECIDED BY BINDING ARBITRATION ON AN INDIVIDIAUL BASIS. Arbitration on an individual basis means that you will not have, and you hereby waive, the right for a judge or jury to decide your claims, and that you may not proceed in a class, consolidated, or representative capacity. Other rights that you and we would have in court will not be available or will be more limited in arbitration, including discovery and appeal rights. 

The arbitrator, and not any federal, state, or local court or agency, shall have exclusive authority to resolve any dispute arising under or relating to the arbitrability or the interpretation, applicability, enforceability, or formation of this Policy, including any claim that all or any part of this Policy is void or voidable. 

CHOICE OF LAW AND VENUE 

This Policy has been made in, and shall be construed in accordance with, the laws of the State of North Carolina, without giving effect to any conflict of law principles.  The arbitration of any claim arising from or relating to this Policy will be conducted in Charlotte, North Carolina.   Any action arising from or relating to this Policy or its claimed breach, or to ant arbitration conducted relating to this Policy, shall be commenced, and resolved only in a federal or state court located in Charlotte, North Carolina and you consent to the exercise of personal jurisdiction by and exclusive venue in such courts. 

Pursuant to Section 1798.83 of the California Civil Code, residents of California can obtain certain information about the types of personal information that companies with whom they have an established business relationship have shared with third parties for direct marketing purposes during the preceding calendar year. That law provides that consumers may request a copy of the personal information that we hold about you. 

Consumers may also request information regarding the categories of personal information that have been shared with third parties, the names and addresses of those third parties and examples of the types of services or products marketed by those third parties. In the event you submit, or your authorized agent submits on your behalf, a data request, you (and your authorized agent) hereby acknowledge and agree, under penalty of perjury, that you are (or the authorized agent of) the consumer whose personal information is the subject of the request. We will respond to any data requests within the timeframes required by law, and we may charge a fee to facilitate your request where permitted by law. If you make, or an authorized agent on your behalf makes, any request related to your personal information, we will ascertain your identity to the degree of certainty required under applicable law before addressing your request. Section 1798.83 of the California Civil Code permits California residents to request from a business, with whom the California resident has an established business relationship, certain information about the types of personal information the business has shared with third parties for those third parties’ direct marketing purposes, and the names and addresses of the third parties with whom the business has shared such information during the immediately preceding calendar year.
