NFPA 96 Compliance for El Paso and Las Cruces Restaurants
If you run a commercial kitchen in this region, there is a good chance your business crosses a state line that your fire inspector does not.
A restaurant group might have one location on Mesa Street, another in Sunland Park, and a third in Las Cruces. Same owner, same equipment, same cleaning contractor — but three different authorities with the power to write you up. Operators reasonably assume that means three different rulebooks.
It mostly doesn’t. Here is what actually governs your hood system on each side of the border, what inspectors on both sides look for, how often the system has to be serviced, and what your file needs to contain before someone asks to see it.

NFPA 96 covers the whole system, not just the cleaning
The most common and most expensive misunderstanding is that NFPA 96 is a cleaning standard.
It isn’t. NFPA 96 — the Standard for Ventilation Control and Fire Protection of Commercial Cooking Operations — governs the entire exhaust system as one assembly: the hood, the filters, the ductwork, the fan, the fire suppression system, the roof penetration, and the access you need to maintain all of it.
That distinction decides real inspections. A kitchen can have a spotless, freshly cleaned hood and still fail, because:
- the ductwork has no access panels, so nobody can verify what’s inside it
- the fan discharges too close to the roof surface or to a fresh-air intake
- there’s no hinge kit, so the fan base has never actually been cleaned underneath
- grease is running onto the roof membrane with no containment
- the filters are the wrong type, or there are gaps in the filter bank
None of those are cleaning failures. All of them are NFPA 96 failures. You can buy a perfect cleaning and still be out of compliance.
The practical version: follow the grease path from the cooking surface to the roof, and make sure every component on it was either inspected, cleaned, or documented as unreachable.

Both sides of the state line run the same code edition
This is the part that surprises multi-location operators, and it works in your favor.
El Paso enforces the 2021 International Fire Code, adopted by city ordinance to replace the 2015 edition. The El Paso Fire Department’s Fire Marshal’s Office handles fire code compliance and plan review, and its Fire Plan Review function explicitly covers special extinguishing systems, range hoods included.
Las Cruces also enforces the 2021 International Fire Code. The New Mexico State Fire Marshal’s Office adopted the 2021 IFC statewide, so the technical baseline in Doña Ana County matches the one across the line in Texas.
The IFC doesn’t rewrite hood requirements from scratch. It points to NFPA 96 as the technical standard and gives it legal force. So the engineering answer — how the duct must be built, how often it must be cleaned, what access it needs — is the same in Canutillo and in Mesilla.
What differs is who shows up, and what they emphasize. The standard is shared. The enforcement culture is local. That’s the practical distinction to plan around.
El Paso: who enforces, and what they focus on
In the city of El Paso, fire code compliance runs through the Fire Marshal’s Office. Two things matter for a commercial kitchen:
Plan review before you build or modify. If you’re installing a hood, replacing a suppression system, changing your cooking line, or altering the exhaust, that work goes through Fire Plan Review. Retrofitting after an inspector sees it is far more expensive than getting the review right the first time.
Ongoing inspection of the operating business. El Paso operates an Operational Fire License program for commercial businesses, and inspections attach to it. A failed hood inspection is not an isolated note — it’s attached to your ability to operate.
A specific change worth knowing if you run a food truck: since July 1, 2026, El Paso has required an annual Fire License Inspection for all Mobile Food Preparation Vehicles operating within city limits, at $125 annually plus $72 per re-inspection. If you run both a brick-and-mortar kitchen and a truck, that’s a second compliance obligation on a separate clock.
Las Cruces and Doña Ana County: the business license gate
Las Cruces Fire Department’s Fire Prevention division enforces the 2021 IFC, conducts existing commercial building inspections, and handles plan review.
The requirement that catches operators is hood classification. Las Cruces guidance is direct: commercial ranges using grease-producing cooking methods must have a Type I hood with a suppression system installed and maintained — their materials specify an ANSUL system. Kitchens using only non-grease methods may operate under a Type II hood, but the business owner signs an agreement restricting cooking methods to those non-grease processes.
That agreement is binding in a way people forget. Sign a Type II restriction, then add a fryer or a char-grill eighteen months later, and you are operating outside your own signed agreement — with a hood that is not rated for what’s under it.
And the enforcement hook is sharper than El Paso’s: new businesses in Las Cruces need fire department approval before the city issues a business license. Fire prevention isn’t a problem you deal with after opening. It’s between you and the ability to open.

NFPA 96 sets minimum inspection and cleaning intervals based on how much grease the kitchen is likely to produce and whether solid fuel is in use. If more than one row applies to your kitchen, use the shortest interval. And if grease is visible before the next scheduled service, the interval is already too long — that is the single most reliable signal you will get, and it arrives before the inspector does.
Changes that should trigger an immediate review of your schedule: adding solid fuel or a smoker, adding charbroiling or heavy frying, extending operating hours, taking on catering or delivery production, installing new cooking equipment, or receiving AHJ direction to shorten the cycle.
A sticker is not a record
Documentation is where most kitchens discover the gap between service performed and compliance provable.
A current hood cleaning sticker tells an inspector two things: a vendor was here, and this was the date. It does not show whether the ducts were opened, whether the rooftop fan was cleaned, whether anything was unreachable, or whether the interval still matches what you cook.

Keep the file where the manager on duty can produce it in two minutes. A vendor portal that nobody on site can log into is not a record during an inspection.
Photo documentation should go past the hood: plenum, duct access interiors, fan blades, fan base, roof interface, and grease containment. Timestamped photos are stronger because they tie the record to a specific site and service window.
