Same owner, same equipment, same cleaning contractor — but three different authorities with the power to write you up. Operators reasonably assume that means three different rulebooks.

It mostly doesn’t. Here is what actually governs your hood system on each side of the border, what inspectors on both sides look for, how often the system has to be serviced, and what your file needs to contain before someone asks to see it.

This is not legal advice and it does not replace direction from your local Authority Having Jurisdiction (AHJ). id="NFPA_96_covers_the_whole_system_not_just_the_cleaning">NFPA 96 covers the whole system, not just the cleaning

The most common and most expensive misunderstanding is that NFPA 96 is a cleaning standard.

It isn’t. NFPA 96 — the Standard for Ventilation Control and Fire Protection of Commercial Cooking Operations — governs the entire exhaust system as one assembly: the hood, the filters, the ductwork, the fan, the fire suppression system, the roof penetration, and the access you need to maintain all of it.

That distinction decides real inspections. A kitchen can have a spotless, freshly cleaned hood and still fail, because:

the ductwork has no access panels, so nobody can verify what’s inside it

the fan discharges too close to the roof surface or to a fresh-air intake

there’s no hinge kit, so the fan base has never actually been cleaned underneath

grease is running onto the roof membrane with no containment

the filters are the wrong type, or there are gaps in the filter bank

None of those are cleaning failures. All of them are NFPA 96 failures. You can buy a perfect cleaning and still be out of compliance.

The practical version: follow the grease path from the cooking surface to the roof, and make sure every component on it was either inspected, cleaned, or documented as unreachable.

Component

What should be verified

Why it matters

Hood canopy

Interior surfaces and grease collection areas inspected

Visible grease is what triggers a closer look at everything else

Grease filters

Present, seated flush, undamaged, correct type

Gaps and wrong filter types push grease deeper into the system

Plenum

Area behind the filters opened and checked

Grease collects here long before it’s visible at the hood

Ductwork

Accessible horizontal and vertical runs opened

Duct grease is invisible until someone opens the system

Access panels

Panels exist, open, and reseal properly

No access means no verification is possible

Rooftop fan

Blades, housing, base, and upper duct connection included

The fan is part of the grease-bearing path, not an accessory

Grease containment

Roof surface and containment checked

Discharge onto the membrane is a fire, roof, and property problem

Suppression system

Serviced and documented separately

Suppression records do not prove exhaust cleaning

Both sides of the state line run the same code edition

This is the part that surprises multi-location operators, and it works in your favor.

El Paso enforces the 2021 International Fire Code, adopted by city ordinance to replace the 2015 edition. The El Paso Fire Department’s Fire Marshal’s Office handles fire code compliance and plan review, and its Fire Plan Review function explicitly covers special extinguishing systems, range hoods included.

Las Cruces also enforces the 2021 International Fire Code. The New Mexico State Fire Marshal’s Office adopted the 2021 IFC statewide, so the technical baseline in Doña Ana County matches the one across the line in Texas.

The IFC doesn’t rewrite hood requirements from scratch. It points to NFPA 96 as the technical standard and gives it legal force. So the engineering answer — how the duct must be built, how often it must be cleaned, what access it needs — is the same in Canutillo and in Mesilla.

What differs is who shows up, and what they emphasize. The standard is shared. The enforcement culture is local. That’s the practical distinction to plan around.

El Paso: who enforces, and what they focus on

In the city of El Paso, fire code compliance runs through the Fire Marshal’s Office. Two things matter for a commercial kitchen:

Plan review before you build or modify. If you’re installing a hood, replacing a suppression system, changing your cooking line, or altering the exhaust, that work goes through Fire Plan Review. Retrofitting after an inspector sees it is far more expensive than getting the review right the first time.

Ongoing inspection of the operating business. El Paso operates an Operational Fire License program for commercial businesses, and inspections attach to it. A failed hood inspection is not an isolated note — it’s attached to your ability to operate.

A specific change worth knowing if you run a food truck: since July 1, 2026, El Paso has required an annual Fire License Inspection for all Mobile Food Preparation Vehicles operating within city limits. If you run both a brick-and-mortar kitchen and a truck, that’s a second compliance obligation on a separate clock.

Las Cruces and Doña Ana County: the business license gate

Las Cruces Fire Department’s Fire Prevention division enforces the 2021 IFC, conducts existing commercial building inspections, and handles plan review.

The requirement that catches operators is hood classification. Las Cruces guidance is direct: commercial ranges using grease-producing cooking methods must have a Type I hood with a suppression system installed and maintained — their materials specify an ANSUL system. Kitchens using only non-grease methods may operate under a Type II hood, but the business owner signs an agreement restricting cooking methods to those non-grease processes.

That agreement is binding in a way people forget. Sign a Type II restriction, then add a fryer or a char-grill eighteen months later, and you are operating outside your own signed agreement — with a hood that is not rated for what’s under it.

And the enforcement hook is sharper than El Paso’s: new businesses in Las Cruces need fire department approval before the city issues a business license. Fire prevention isn’t a problem you deal with after opening. It’s between you and the ability to open.

El Paso and Las Cruces side by side

El Paso, TX

Las Cruces / Doña Ana County, NM

Fire code in force

2021 International Fire Code

2021 IFC, via the New Mexico Fire Code

Technical standard for hoods

NFPA 96, referenced by the IFC

NFPA 96, referenced by the IFC

Who enforces

EPFD Fire Marshal’s Office

LCFD Prevention Services

Plan review trigger

New hood, suppression change, cooking line or exhaust alteration

New hood, suppression change, cooking line or exhaust alteration

Operating permit link

Operational Fire License; inspections attach to it

Fire department approval required before the city issues a business license

Distinctive local emphasis

Mobile Food Preparation Vehicle annual fire inspection

Type I vs Type II hood classification agreement

What a failure puts at risk

Your operating license

Your ability to open at all

The takeaway for a multi-location operator: build one compliance program to the NFPA 96 standard, then layer the two local permit calendars on top of it. You do not need two sets of engineering answers. You do need two sets of paperwork deadlines.

How often your system has to be cleaned

NFPA 96 sets minimum inspection and cleaning intervals based on how much grease the kitchen is likely to produce and whether solid fuel is in use. Local fire officials on both sides of the line can and do require shorter intervals when they see heavy accumulation, long operating hours, solid-fuel cooking, or a history of violations.

If you want to read the interval table yourself, NFPA publishes its standards for free online reading — you only need a free account.

Operation type

Typical cooking profile

NFPA 96 minimum

What to expect in practice

Wood-fired pizza, mesquite grills, smokers

Solid fuel, live fire, embers

Monthly

Monthly, with little tolerance for visible grease

Steakhouses, carne asada, Korean BBQ

Open flame, heavy fat rendering

Monthly to quarterly

Usually monthly, given the grease load

Fast food and QSR

Continuous frying, griddles, long hours

Quarterly

Quarterly, tightened to monthly if hours are long

24-hour diners, high-volume wok kitchens

Constant cooking, high exhaust demand

Quarterly

Monthly to quarterly depending on findings

Casual dining, sports bars, family restaurants

Fryers plus grills, moderate use

Semi-annual if genuinely moderate

Often enforced as quarterly

Fine dining, mostly sauté and roast

Lower grease volume

Semi-annual

Quarterly or semi-annual; inspectors judge grease, not price point

Hotel banquet and catering commissaries

Heavy production in bursts

Quarterly to semi-annual

Usually quarterly for risk and insurance alignment

Hospitals, large school cafeterias

High meal counts, limited frying

Semi-annual

Semi-annual, quarterly if fryers or grills are present

Churches, community halls, lodges

Occasional, low volume

Annual

Annual, often before peak event seasons

Seasonal concessions and camps

Short season, some frying

Annual

Annual plus a pre-opening cleaning

If more than one row applies to your kitchen, use the shortest interval. And if grease is visible before the next scheduled service, the interval is already too long — that is the single most reliable signal you will get, and it arrives before the inspector does.

Changes that should trigger an immediate review of your schedule: adding solid fuel or a smoker, adding charbroiling or heavy frying, extending operating hours, taking on catering or delivery production, installing new cooking equipment, or receiving AHJ direction to shorten the cycle.

A sticker is not a record

Documentation is where most kitchens discover the gap between service performed and compliance provable.

A current hood cleaning sticker tells an inspector two things: a vendor was here, and this was the date. Both enforce the 2021 International Fire Code, which points to NFPA 96 for commercial kitchen exhaust requirements. What differs is enforcement: El Paso ties inspections to its Operational Fire License, while Las Cruces requires fire department approval before the city issues a business license.

How often does a restaurant hood need to be cleaned in El Paso?

NFPA 96 sets the minimum by grease load: monthly for solid-fuel cooking, quarterly for high-volume operations, semi-annually for moderate volume, and annually for low-volume kitchens. Local fire officials can require shorter intervals based on what they observe.

Does NFPA 96 require the rooftop fan and ductwork to be cleaned?

Yes. The exhaust system is the whole grease-bearing path — hood, filters, plenum, ducts, access points, and fan. A cleaning that stops at the hood leaves the majority of the system unverified.

What records should I keep after a hood cleaning?

A written report describing actual scope, the service date, the vendor and crew, areas inspected and cleaned, anything unreachable, before-and-after photos, a deficiency log, corrective-action records, and the current service tag. Kitchens using only non-grease methods may operate under a Type II hood, but the owner signs an agreement restricting cooking to those methods. Adding a fryer or char-grill later puts you outside that agreement.

Who is responsible for compliance, the restaurant or the cleaning company?

The owner or operator.
